1. Basic Provisions

• These terms and conditions apply to all transactions made with Spice Junction through our website, info@spicejunction.de. Any attempt to include your own conditions is hereby rejected unless explicitly agreed upon otherwise.
• For the purposes of these terms, a 'consumer' is any natural person engaging in transactions that predominantly are outside the scope of their commercial or professional activities. A 'business' refers to any natural person, legal entity, or partnership with legal capacity acting in the execution of their independent professional or commercial activities when entering into a transaction.

2. Contract Formation

• Our website listings of products constitute binding offers on our part, inviting your acceptance under the conditions specified in those listings.
• A contract through our online shopping cart system is formed as follows: Products intended for purchase are placed in the "shopping cart." You can access and modify the shopping cart at any time. Upon accessing the “Checkout” page and entering the necessary personal data, payment, and shipping details, a final summary of your order is presented. If using an instant payment system (e.g., PayPal, Amazon Payments, Sofort), you may be redirected to complete payment before being shown the final order summary in our shop. Final confirmation of your order through the “purchase” button constitutes your binding acceptance of the offer, at which point the contract is concluded.
• Your requests for quotes are not binding. We will provide you with a binding offer in text form (e.g., via email), which you can accept within a period of 5 days.
• Order processing and contact usually take place via email and automated order processing. It is your responsibility to ensure the email address you provide for order processing is accurate so that emails sent by us are received. Specifically, you must ensure that our emails are not filtered out by SPAM blocking.

3. Retention of Title and Right of Retention

• You can only exercise a right of retention insofar as it pertains to claims from the same contractual relationship.
• The goods remain the property of Spice Junction until the purchase price is paid in full.

4. Warranty

• Statutory warranty rights apply.
• As a consumer, you are encouraged to immediately inspect the product upon delivery for completeness, visible defects, and transport damage, and to inform us and the carrier of any issues promptly. Failure to do so will not affect your statutory warranty claims.

5. Applicable Law, Jurisdiction

• German law applies. For consumers, this choice of law applies only to the extent that it does not remove any mandatory consumer protections provided by the law of the country in which the consumer has their habitual residence.
• For disputes arising from this contract, if the customer is a business, legal entity under public law, or a special fund under public law, the jurisdiction and place of fulfillment is our place of business. This also applies if the customer does not have a general jurisdiction in Germany or the EU, or if their place of residence or habitual residence is not known at the time of filing a lawsuit. The ability to appeal to another court of jurisdiction remains unaffected.
• The UN Convention on Contracts for the International Sale of Goods is explicitly excluded.

• The prices listed and shipping costs are total prices. They include all price components, including all applicable taxes. Payment and shipping information, including any additional costs, are clearly communicated on our website or in the respective offer.

7. Statutory Warranty

• Warranty for defects follows the "Warranty" section of our General Terms.

8. Minors Protection Policy

• We adhere to laws regarding the sale of alcohol: No sale to those under 16. Beer and wine to those 16 and older; spirits, aperitifs, and alcopops only to those 18 and older.
